These terms apply to the somersaudio.com website and to the applications we distribute from it. By using the site or our software, you agree to them. Individual applications may also have their own terms — where they differ, the application's own terms govern that application.

Licence

Our software is licensed to you, not sold. Subject to these terms, you may install and use it for your own personal or business use. Unless a particular product's terms say otherwise, you may not resell, sublicense or redistribute our software, or remove or alter its licensing, branding or copyright notices.

Professional use — verify before you rely on it

Important. Our applications are engineering aids for audio professionals. They assist with decisions such as amplifier and loudspeaker configuration, impedance and load calculations, and mixing-console control. They do not replace your own professional judgement. Always verify results against the manufacturer's official documentation and specifications before energising a system, connecting loudspeakers, or applying changes to a live console. You remain responsible for the safety and correctness of any system you design, operate or modify.

No warranty

Our website and software are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the software will be error-free or uninterrupted, or that any calculation, transcription or command it produces will be correct or suitable for your situation.

Limitation of liability

To the fullest extent permitted by law, Somers Audio and John Somers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill, equipment or business, arising out of or related to your use of (or inability to use) the website or our software — including damage to audio equipment, disruption to a performance or event, or loss of a recording — even if we have been advised of the possibility of such damages. Nothing in these terms excludes liability that cannot lawfully be excluded.

Downloads and updates

Installers are distributed from our own official release pages. Please download our software only from this website or those official pages; we cannot vouch for copies obtained anywhere else. Some applications check for updates automatically so you can stay on a current, signed build.

Third-party trademarks and independence

Somers Audio is an independent developer and is not affiliated with, authorised, sponsored or endorsed by any of the manufacturers whose equipment our software works with. L-Acoustics, Behringer, Midas, Yamaha, Allen & Heath and all other product and company names are the trademarks of their respective owners, used here only to identify the equipment our software is compatible with. Our "Unofficial L-Acoustics Calculator" is exactly that — an unofficial, third-party tool that is not an L-Acoustics product and is not endorsed by L-Acoustics.

Acceptable use

Don't use this website or our software unlawfully, don't attempt to disrupt or gain unauthorised access to it or to any system it connects to, and don't use it to infringe anyone else's rights — including using voice-conversion features to impersonate a person without their consent or to create misleading material.

Intellectual property

The website, its content, and our software remain the property of Somers Audio and its licensors, and are protected by copyright and other laws.

Changes

We may update these terms; the "last updated" date above will change when we do. Continuing to use the site or software after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.
